Names Released in August 21 Murder, LIVINGSTON, August 22, 2009 - A senseless murder takes a life from one of the best known families in Livingston. On Friday August 21, 2009, at approximately 10:25 pm, the Livingston Police Department responded to a home invasion robbery that had just occurred in the 1000 block of Polk Street in Livingston. Upon arrival, officers found one victim deceased in the home identified as Billy Ray Kimberlin, Jr., 40, of Livingston. Witnesses reported that two armed suspects had entered the residence and while in commission of robbing the occupants of the residence, shot Kimberlin. Witnesses reported that the two suspects then fled the residence on foot. Officers from the Livingston Police Department, Polk County Sheriff's Office, Department of Public Safety and Polk County District Attorney's Office began a search of the immediate area. Shortly thereafter one suspect was taken into custody in the parking lot near Subway in Livingston (less than a mile from the scene of the crime). The apprehended suspect, Alderick Lapaul Johnson, 18, of Houston, was transported to the Polk County Sheriff's Office and charged with Capital Murder. Polk County Justice of the Peace Pct. 4, Steven McEntyre was called to the scene and pronounced Kimberlin deceased. An autopsy of Kimberlin was ordered by Judge McEntyre and is pending with the Jefferson County Morgue. The second suspect was not located and is not believed to be in the Livingston area.
