3 Busted on Marijuana Related Charges, LIVINGSTON, July 9, 2011 - On July 7, 2011, while patrolling in the area of US-190 West just east of Onalaska, Lieutenant Andy Lowrie and Sergeant Howard Smith with the Polk County Sheriff's Office were observing traffic when they observed a vehicle that was very familiar them pass their location. Lowrie observed that the passenger in the vehicle appeared to not be wearing his seat belt. The Detectives pursued the vehicle in heavy traffic and observed that the vehicle was following closely behind another vehicle; too close. A traffic stop was initiated on the vehicle just off 190 West after the driver turned onto FM-3126 North. The driver, Clyde Lovellette Haynes, Jr., 27, of Livingston, was asked for his driver's license and proof of insurance. While waiting, Lieutenant Lowrie could smell a strong smell of green (not burned) marijuana emitting from inside the vehicle. Clyde and his passenger, Irvin Dwayne Cummings, 39, of Livingston, were removed from their vehicle and secured. Sitting under Irvin Cummings' legs was a large black trash bag and a bag of food. Lowrie opened the bag and found five 1 gallon size individual packages containing marijuana. The approximate weight of the marijuana came to twenty two ounces. Information obtained from the evidence collected from inside the vehicle indicated that Clyde Haynes and Irvin Cummings were transporting the illegal herb into the Polk County area to distribute it in Polk County.
A Cell Phone Goes Off... During the investigation, a man by the name of Steven Adam Shelby, 19, called Haynes' cell phone. Lieutenant Lowrie answered the phone. Shelby never asked who he was speaking with and apparently assumed he was speaking with Haynes. Shelby told Detective Lowrie that he would like to order a quarter of an ounce of marijuana and was kind enough Lowrie his location. Lowrie and Smith responded to Shelby's request and met him at a business located in Livingston. The detectives met Shelby at his place of employment and found him to be in possession of a pipe used for smoking marijuana and he also had a small amount of marijuana. The business manager explained that this was Shelby's first day on the job and could not believe that Shelby would actually order marijuana and arrange to have a dealer bring it to his job sight.
Clyde Haynes was charged with felony possession of marijuana. Haynes was already on probation for marijuana related charges when he was caught by Lowrie and Smith.
Irvin Cummings was charged with felony possession of marijuana. Cummings was also already on probation for selling marijuana out of his house located in Memorial Point.
Steven Shelby was arrested for drug paraphernalia.
