Texas Department of Public Safety Releases Statement Regarding Officers Involved Shooting in Livingston...
LIVINGSTON – The Texas Department of Public Safety (DPS) Texas Rangers are investigating an officer-involved shooting that occurred last night on April 2, in the 100 block of Pan American Drive, in the City of Livingston.
The preliminary information indicates that officers with the Livingston Police Department and the Polk County Sheriff’s Office responded to a report of a man displaying a gun in the 100 block of Pan American Dr.
Upon arrival, officers located the suspect and gave commands, both in English and Spanish, for the suspect to drop the weapon. The suspect then pointed the gun at the officers when he was shot by the first responders.
Immediately, the officers began rendering life-saving measures until emergency medical personnel arrived and transported the suspect to CHI St. Luke’s Hospital in Livingston, where he was pronounced deceased.
The suspect is identified as Jose Luis Hernandez, 66, from Livingston.

According to witnesses, the suspect who was shot was in the parking lot of the Exxon station. He walked up to a woman who was sitting in her vehicle. The woman closed her window and the suspect pulled the pistol from his back pocket, pointed it at the woman, and acted like he was shooting. The woman called 911. When police showed up, the suspect had left the parking lot and was at the grassy embankment next to the SweatShop Gym.

Officers Involved Shooting, LIVINGSTON, April 2, 2023 - At approximately 7:55 pm on April 2, 2023, Officers with Livingston Police Department were dispatched to Pan American Drive. The incident started on a grassy embankment next to the Sweat Shop Gym. A hispanic male (possibly intoxicated) was in possession of a firearm and allegedly waving it around. Officers with LPD showed up and was quickly backed up by Deputies from the Polk County Sheriff's Office and a State Trooper. Police tried for around ten minutes to get the man to put the gun down, speaking in Spanish. The man wasn't cooperating. The situation moved next door to the Exxon Station at 111 Pan American Drive. The man was shot (apparently pointed the gun at the officers). An ambulance showed up and took the man from the scene. A police line was set up, detectives from Livingston PD and the Polk County Sheriff's Office were summoned as well as a Texas Ranger who's the lead investigator. That's all the information we have at this time.
The situation appeared to have started on this embankment located next to the SweatShop Gym.
Sheriff Byron Lyons and Livingston Police Chief, Matt Parrish were on the scene.
The shooting appeared to have happened in a drive area behind the Exxon located at 111 Pan American Drive.
