Trooper Chris Cain pours out whiskey from a flask that was found in possession by 55 year old Robert Lee Sutterfield of Livingston.
Driver Loaded Down with Alcoholic Beverage Arrested for DWI, ONALASKA, June 20, 2012 - At approximately 9:30 pm on June 19, 2012, Trooper Chris Cain was patrolling US-190 West when he spotted an east-bound older model GMC truck with a head lamp out. Trooper Cain pulled the truck over in front of A Action Realty. When Cain spoke to the driver, Robert Lee Sutterfield, 55, of Livingston, Cain smelled alcohol coming from Sutterfield and was suspicious of intoxication. Cain attempted to conduct a field sobriety test on Sutterfield. According to Sutterfield, physical problems kept him from being able to do the balance tasks required on the test. Cain asked Sutterfield to recite the alphabet, but according to Cain, Sutterfield couldn't recite the alphabet, he wasn't even close. Cain placed Robert Sutterfield under arrest for suspicion of driving while intoxicated. Records indicate that Sutterfield already has at least 2 other convictions for DWI making this possibly his third (if he's convicted) making this felony DWI. Cain placed cuffs on Sutterfield and took him to Polk County Jail where he administered a breathalyzer test in which Sutterfield blew a .182 (over twice the legal limit). Sutterfield had a dog in the cab of his truck (a Rat Terrier). Seeing the situation with the dog, rather than call a tow truck, out of concern for the dog's welfare, Cain got in touch with family of Sutterfield who came and picked up the truck and drove it away from the scene (ensuring the dog is safely with family). Sutterfield had a flask of whiskey, open can of cold beer, and cans of cold beer in a cooler in the cab of the truck, and a cooler of cold beer in the bed of the truck.
Cain pulled Sutterfield over for a faulty head lamp that was out on Sutterfield's truck.
Cain placed Robert Sutterfield under arrest for suspicion of driving while intoxicated.
