Pasadena Man Busted for DWI, LIVINGSTON, May 29, 2010 – Shortly before 8 pm on May 29, 2010, Lieutenant Andy Lowrie with the Polk County Sheriff’s Office spotted a silver 2001 Saturn wagon swerving on US-59 South in Livingston. The vehicle was being driven by Jose’ Garcia, 45, of Pasadena. Lowrie pulled the vehicle over in the parking lot of Wal-Mart Super Center. When Lowrie spoke with Garcia, he smelled the scent of alcohol coming from Garcia. Lowrie was joined moments later by Lieutenant Mark Jones (also with the Sheriff’s Office). Lowrie attempted to administer a field sobriety test on Garcia. After unsuccessfully trying a simple task required in a FST, Garcia refused to do anything else pertaining to the test. Garcia was placed under arrest for suspicion of driving while intoxicated. Garcia was transported to Polk County Jail where he was required to submit a breathalyzer test or have blood drawn as part of No Refusal Weekend. Garcia’s vehicle was towed by LakeView Wrecker Service and will be stored in Livingston. The scene was cleared by 8:30 pm.

When Garcia refused to continue the field sobriety test he was placed under arrest for suspicion of driving while intoxicated.
Garcia took a seat while Lowrie prepared to do a vehicle search.
Lieutenant Lowrie did find a bottle of alcoholic beverage and an open container that Garcia had been drinking from (open container did contain alcohol).
Detective Christy Allen was summoned to transport Garcia to Polk County Jail.
Garcia threatened to "shoot my a__" for taking his picture (so I made sure to get a close up shot).
Garcia's 2001 Saturn was towed by LakeView Towing.
