Guilty, But Defiant, Defendant Sentenced to Prison After Trying to Sexually Assault His Own Niece, LIVINGSTON, January 9, 2014 - On Tuesday January 7, 2014 Rudy Trujillo Dimas was sentenced to the maximum sentence of 10 years in prison for the offense of Assault Family Violence by Impeding Breath and one year in the Polk County Jail for Assault Family Violence causing Bodily Injury. Prosecutor Brian Foley of the Polk County District Attorney’s Office explained that Dimas was smoking crack at his home off of Mill Gate Road in Livingston Texas and attempted to make sexual advances towards his adult niece. Mr. Dimas chased his niece into the woods outside his home where she called 911. He caught up to her and punched and choked her until he ran off into the woods just before police arrived. During his trial two other women came forward indicating Mr. Dimas had assaulted and strangled them in the past even chasing one of them with a knife. At his punishment hearing Mr. Dimas refused to accept responsibility for the assault even as Mr. Foley played the 911 recording which had recorded the defendant’s voice and his niece screaming, “Rudy please stop”.
