Hemm stopped and was waiting to make a left turn into a private driveway when he was slammed from behind by a silver 2010 Dodge Charger, driven by Javier Moreno Turrubiartes, 22, of Livingston. Turrubiartes attempted to swerve to avoid striking Hemm. Turrubiartes' driver's side fender slammed into the rear passenger's side of Hemm's vehicle. Americare Ambulance Service was dispatched to the scene along with the Alabama Coushatta Fire Department and Troopers Nick Hatton, Kevin Burman, and Zach Lenderman with the Texas Highway Patrol. Turrubiartes and Tindel were transported by ambulance to CHI Livingston Memorial Hospital with non-life-threatening injuries. Hemm was physically okay.
