Railey's pickup veered right and slammed into a guardrail about a mile from FM-3126. According to witnesses, Railey was trying to flee the scene. Railey was stopped by an off duty Sheriff's Deputy who drove up on the scene. The scene was held until Sergeant Adam Norris, and Deputy Byron Dunaway with the Polk County Sheriff's Office arrived. Trooper Zach Lenderman with the Texas Highway Patrol was dispatched to investigate. Trooper Lenderman administered a field sobriety test on Railey and placed Railey under arrest for driving while intoxicated. This is Railey's third or more DWI which makes this charge a felony DWI. Railey's pickup also had cold beer inside. Railey's vehicle was recovered by All Star Wrecker Service and will be stored in Livingston.
