Felons Plead Guilty, LIVINGSTON, December 16, 2019 - On December 16, 2019, Justin Ray Hope, Sr., Justin Ray Hope, Jr., and Brandy Hope plead guilty to felony drug charges stemming from a search warrant executed by the Livingston Police Department on their residence at 1211 Brinwood Place in Livingston on August 22, 2017. During the search of the residence on that date, Livingston Police officers found in excess of 400 grams of methamphetamine, approximately 900 assorted pills identified as controlled substances and included morphine, ecstasy, methamphetamine tablets and marijuana. Officers also recovered several handguns along with items used for the sale of illegal narcotics. Pursuant to the plea bargain agreement which was approved by visiting 258th Judge Lisa Burkhalter, Justin Ray Hope, Sr., received a sentence of twenty-five years confinement in the Texas Department of Criminal Justice. Justin Ray Hope, Jr. received a sentence of ten years confinement in the Texas Department of Criminal Justice. Brandy Hope entered an “open” plea of “guilty” to Burkhalter and will be sentenced at hearing before the court at a later date. The plea bargains were finalized between defense counsel and Polk County Assistant District Attorney Nicole Washington following a suppression hearing on December 12, 2012, during which Judge Burkhalter denied the defendants’ motions to suppress the evidence collected during the search of their home. During the hearing, Livingston Police Detective Marty Drake testified that officers had obtained probable cause to believe the defendants were involved in the distribution of controlled substances from the residence and had obtained a search warrant from Polk County Court at Law Judge Tom Brown prior to entering the residence and discovering contraband.
